Transferring or reselling a RAJUK flat

A RAJUK-allotted flat cannot change hands without permission. The documents, the steps, and what a buyer should verify first.

Nothing changes hands without permission

Whenever a RAJUK-allotted property changes hands — by purchase, sale or inheritance — obtaining RAJUK’s sale or transfer permission is mandatory. This is not a formality; a transfer done without it does not stand on the record afterwards.

Which means money and keys changing hands is not the end of the transaction. Until the buyer’s name reaches RAJUK’s books and the land record, the risk sits with the buyer.

What the prospectus says

Under the November 2024 prospectus, a flat cannot be mortgaged, its lease right transferred, any liability created on it, a sale agreement (bayna) made or a power of attorney given without RAJUK’s prior written approval; doing so gets the allotment cancelled. A flat allotted as residential cannot be used for non-residential, commercial or industrial purposes. What is possible, and when:

  • Before the full price is paid: an allottee who has paid the first instalment but cannot pay the rest may, on application and subject to the eligibility conditions, appoint someone under a power of attorney by paying RAJUK’s per-square-foot power-of-attorney fee.
  • After the full price is paid and the lease deed executed: the lease right can be transferred on payment of RAJUK’s per-square-foot transfer fee.
  • If the allottee dies: the legal heirs must apply to RAJUK within 18 months of the death, and the remaining instalments and all conditions pass to them.
  • Surrendering the flat: a written surrender before the full price is paid gets everything refunded without interest, less 5%, within three months.

The documents generally required

  • The original title deed — the seller’s proof of ownership.
  • The mutation certificate, in the seller’s name.
  • Up-to-date utility bills — electricity, water, gas — showing nothing outstanding.
  • Tax and land development tax receipts.
  • RAJUK’s approval, or transfer permission.
  • A No-Objection Certificate from the building authority or management committee.

The list changes over time and individual cases attract extra requirements. Confirm the current list with the relevant RAJUK branch rather than working from a second-hand version of it.

Applications are now online

According to RAJUK’s urgent notice, from 1 September 2026 applications for permission to transfer, gift (heba) or partition, permission to register the related deed, mutation, approval or cancellation of a power of attorney, and a loan no-objection are made and decided online at epms.rajuk.gov.bd. As a buyer, you can ask the seller to show you the permission letter the portal issued.

What a buyer should verify

Look at the paperwork before discussing price. Every flat in this project is built to one design, so what is actually being negotiated is not the layout — it is the documents, the floor, the aspect, and how much of the instalment schedule is left.

  • The name on the allotment letter and the name on the deed are the same.
  • How much of the instalment schedule is outstanding, and — in writing — who carries it after the sale.
  • Whether service charge or utility bills are in arrears.
  • Flat number, building code and floor match on paper and on site.
  • Whether a car parking slot has been separately allotted, and whether it is included in the transfer.

Before you advertise

Listing a flat on ruap.net is free for owners and allottees, and every listing is checked before it is published. Having the documents in order before you list means the first questions a serious buyer asks are already answered.

Common questions

Can a RAJUK flat be sold without permission?
No. Transfer permission from RAJUK is mandatory whenever an allotted property changes hands, whether by sale or by inheritance.
Can it be sold while instalments are still running?
Under the prospectus the lease right is transferred after the full price is paid and the lease deed executed. Before that, once the first instalment is paid, there is a power-of-attorney route on payment of RAJUK’s fee. Both need RAJUK’s approval — and settle in writing who carries any outstanding instalments.
What happens if the allottee dies?
The legal heirs must apply to RAJUK within 18 months of the death, and take on the remaining instalments. Mutation by inheritance and the revised allotment letter are now applied for at epms.rajuk.gov.bd.
What is the biggest risk for a buyer?
A deed without mutation, and a transfer without permission. Neither puts your name on the government record.
